Works for the insurer

Company / Staff Adjuster

A salaried employee of your insurance company. Assigned automatically when you file — no fee to you, but no obligation to maximize your payout either.

These terms get confused often — and the difference determines whose side someone is actually on.

How we operate: We don't door-knock, cold-call, or pressure anyone to sign on the spot. You reach out to us — never the other way around.

Massachusetts law (M.G.L. c. 175, § 172) requires every public adjuster contract to be in writing, on a form filed with and approved by the Commissioner of Insurance. No improvised contracts, no hidden terms.

  • every contract on a state-approved form

  • Fee of No more than 10%

The Massachusetts Division of Insurance advises that a public adjuster's fee should not exceed 10% of the claim payment. Your exact percentage is written into your contract before you sign, and you pay nothing until your insurer pays.

  • Licensed in Massachusetts

Austin Bernaiche is a licensed public adjuster in Massachusetts (Lic. #20675006). You can verify any adjuster's license with the Massachusetts Division of Insurance or by calling 1-617-521-7794

Massachusetts Public Adjuster Licensing & Fees

Public adjusting is a licensed, regulated profession in Massachusetts. Here's what applies to your claim — and what protects you.

  • three days to change your mind

You can cancel your contract without penalty by written notice within 3 calendar days of receiving your copy (M.G.L. c. 175, § 172). After that, you can still end the contract at any time; we keep a claim to our agreed fee only on insurance money offered or recovered through our work. If you cancel within the 3 days, you remain responsible only for reasonable emergency out-of-pocket costs we paid during that window to protect your property.

  • your policy can't stop you hiring us

Under Chapter 187 of the Acts of 2026, effective November 5, 2026, any policy language that bars you from hiring a public adjuster as a condition of recovery is unenforceable and is removed from the policy. Including it is now an unfair claim settlement practice under M.G.L. c. 176D.

  • no financial ties to contractors

Naiche holds no interest in, and takes no referral fees from, any contractor, restoration company or salvage firm. You choose your own contractor, always.

  • Division of insurance Oversight

Questions or complaints can go to the Division of Insurance Consumer Service Section: 1-617-521-7794 or mass.gov/doi.

Example: how a 10% fee actually works

Insurer's final settlement

$30,000

Naiche's fee (example at 10%)

− $3,000

You receive

$27,000

Illustration only. Outcomes depend on your policy, your loss and the facts of your claim. The fee applies only to the settlement amount — never to money you haven't received, and never before your insurer pays. Deductibles and depreciation holdbacks are separate from this fee and depend on your specific policy.

We don't promise a specific settlement figure or a guaranteed payout — every claim is different. We'll walk you through your policy and how we'd approach the claim before you sign anything.

For a small, straightforward claim that has already been paid in full, you may not need one. Austin will tell you honestly at the consultation whether we can add anything.

  • No. Naiche holds no interest in, and takes no referral fees from, any contractor, restoration company or salvage firm. You choose your own contractor.
